These Terms of Service ("Terms") set forth the conditions and principles governing users' ("Customer") access to and use of the website https://mobile-id.vn/ and the products and services provided by Mobile-ID Technology and Services Joint Stock Company ("Mobile-ID", "we", "us", or "our").

By accessing or using the website and/or our services, the Customer acknowledges that they have read, understood, and agreed to be bound by these Terms.

These Terms apply to:

  • Registration for and use of products and services provided by Mobile-ID;
  • Transactions and interactions between the Customer and Mobile-ID through the website.

3. Conditions of Use

The Customer represents and warrants that they:

  • Have full legal capacity in accordance with applicable laws;
  • Provide accurate, complete, and up-to-date information during registration and throughout the use of the services;
  • Use the services solely for lawful purposes and in compliance with applicable laws and regulations.

For organizational/corporate customers:

  • Ensure that the use of the services is consistent with their business functions, registered business activities, and applicable legal requirements;
  • Ensure that the representative conducting transactions has full authority in accordance with the organization's or enterprise's internal regulations.

Mobile-ID reserves the right to refuse to provide services or suspend an account if any of the above conditions are violated.

4. User Account

When registering an account, the Customer agrees to:

  • Provide accurate, complete, and up-to-date information;
  • Keep account credentials confidential and be responsible for all activities conducted through the account;
  • Promptly notify Mobile-ID upon discovering any unauthorized use of the account.

Mobile-ID reserves the right to suspend or terminate an account if a violation of these Terms or any fraudulent or abusive activity is detected.

5. Customer Rights and Obligations

5.1 Customer Rights
  • Use the lawful products and services provided by Mobile-ID;
  • Receive support and assistance while using the services;
  • Have their personal data protected in accordance with Mobile-ID's Privacy Policy.
5.2 Customer Obligations
  • Comply with applicable laws and these Terms;
  • Not use the website or services for any unlawful purpose;
  • Not engage in any activity that may adversely affect the system, security, or the legitimate rights and interests of Mobile-ID or any third party;
  • Be responsible for the accuracy and legality of the content and information they provide.

6. Mobile-ID's Rights and Obligations

6.1 Mobile-ID's Rights
  • Provide, modify, suspend, or discontinue the services when necessary;
  • Refuse to provide services where violations of applicable laws or these Terms are identified;
  • Implement appropriate technical measures to protect its systems and data.
6.2 Mobile-ID's Obligations
  • Provide services in accordance with its commitments;
  • Protect Customers' personal data in compliance with applicable laws;
  • Provide support to Customers during their use of the services.

7. Suspension or Termination of Services

Mobile-ID may suspend or terminate the provision of services to a Customer under any of the following circumstances:

  • The Customer breaches these Terms or any related agreements;
  • The Customer uses the services for unlawful purposes;
  • Fraudulent activities, abuse of the services, or actions affecting the system, cybersecurity, or information security are detected;
  • As required by a competent governmental authority;
  • In cases of force majeure or technical incidents beyond Mobile-ID's reasonable control.

Mobile-ID will provide the Customer with reasonable prior notice before suspending or terminating the services, except where immediate action is necessary to protect system security or comply with applicable laws.

The suspension or termination of services may result in the restriction or loss of access to the Customer's account and related data.

To the fullest extent permitted by applicable law, Mobile-ID shall not be liable for any damages arising from such suspension or termination, except where otherwise required by law.

8. Payment and Transactions (if applicable)

Terms relating to payments and service fees (if any) shall be specified for each product or in a separate agreement between Mobile-ID and the Customer.

The Customer is responsible for making full and timely payment in accordance with the agreed terms.

9. Intellectual Property Rights

All content available on the website, including but not limited to text, images, logos, designs, software, and other materials, is the property of Mobile-ID or its licensors.

The Customer may not copy, modify, distribute, reproduce, or use such content for commercial purposes without Mobile-ID's prior written consent.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Mobile-ID shall not be liable for:

  • Damages resulting from the Customer's own acts or omissions;
  • Service interruptions caused by technical failures, system outages, telecommunications network issues, or force majeure events;
  • Risks arising from the Customer's failure to follow usage instructions or maintain the confidentiality of their account or information.

11. Privacy

The collection and processing of Customers' personal data is carried out in accordance with the Privacy Policy published on the website.

12. Amendments to the Terms

Mobile-ID reserves the right to amend or supplement these Terms at any time. The updated version will be published on the website.

The Customer's continued use of the services after the updated Terms become effective constitutes acceptance of the revised Terms.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Socialist Republic of Vietnam.

Any dispute arising out of or in connection with these Terms shall first be resolved through good-faith negotiation. If no agreement can be reached, the dispute shall be submitted to the competent authority in accordance with applicable laws.
